secondly, what now, it's a 5 card major strong NT context, but no 2/1 GF (not my preference but meh)

2 probably followed by 3 after the opponents balance and yes I agree with opening 1.

The opponents silence may mean partner has a near max but it's not a non-game forcing 2/1 so if it's the magic KQ and an Ace, thems the breaks.
When a deaf person goes to court is it still called a hearing?

If I am in a gambling mood, I would try 3NT. But I'll normally bid 2H, and 3 as the others mentionned if pushed by opps.

we survived the opening salvo and have discovered the opps have a 8+ card spade fit and I have little intention of letting them back in easily by bidding a measly 2h.Game is 5050 opposite AQ9 of diamonds and a couple of trumps. Cannot see bidding less than 3h here. Even if 4h goes down the opps may have a making 3s hand.

It's no problem about 1. Opening preempt with 12hcp is ridiculous. Secondly, you had best bid 2 when vulnerable. But with favorable vulnerability, notice that any of your opponents can bid a take-out x after 2. I suggest 3 like preempt because it's easy for 2, 3, 3 etc to score better than 3 or even 4 with down without double.

There are plenty of times when preempting with 12hcp is a good move and I am confident many here would open this hand 4 with a different seat/vulnerability combination. 1 is clearly the mainstream choice 1st/red though.

How will your partner know that you intended the 3 rebid as preemptive rather than a game try? I understand bidding 3 for the reasons gszes gives - the hand has a super ODR and it acts as something of a two-way shot - but if you want partner to take this rebid preemptively you best start coughing immediately.
